Terms of service

Welcome to starsafetysupplies.com.au (the "Site"), operated by Aydin Consulting Specialist Pty Ltd (ABN 21 638 963 112), trading as Star Safety Supplies ("we", "us", "our"). These Terms and Conditions ("Terms") apply to your use of the Site and to every order for goods or services placed with us online, by phone, by email, through a quote or in our store. By using the Site or placing an order, you agree to these Terms. Please read them before completing a purchase.

Consumer notice: our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits any right you have that cannot lawfully be excluded.

1. Overview

Star Safety Supplies supplies workplace safety products, including personal protective equipment, workwear, safety signs, first aid, height access, materials handling and site safety products, together with related services. Products are supplied from our own warehouse or through approved supply partners. These Terms apply to all users and purchasers, whether buying as a consumer or for a business. Our Shipping, Delivery and Pickup Policy, Returns and Refunds Policy and Privacy and Cookie Policy form part of these Terms.

2. Accounts and accurate information

  • When you create an account, request a quote, apply for a trade account or place an order, you confirm that the information you give (including name, business, ABN, addresses, email and phone) is true, accurate and current, and that you are authorised to act for any business you name.
  • You are responsible for keeping your sign-in details secure and for activity under your account. Tell us immediately if you suspect unauthorised access.
  • Acting reasonably, we may ask for identity or business verification for fraud prevention and compliance. If verification is refused or cannot reasonably be completed, we may hold dispatch, or cancel the order and refund undelivered goods to the original payment method.

3. Trade accounts

  • Trade accounts, trade pricing and payment terms are available by application and at our discretion. Submitting an application or enquiry does not create an account and does not confirm pricing, credit, availability or delivery arrangements.
  • Unless payment terms have been confirmed by us in writing, payment in full is required before dispatch.
  • Where payment terms are approved, invoices are payable by the due date shown. If an amount is overdue we may suspend the account, hold further orders and recover our reasonable costs of collection. We may review or withdraw payment terms on reasonable notice.
  • Any additional written trade or credit terms we agree with you apply together with these Terms and prevail for their subject matter.

4. Product information

We take reasonable care to keep product information, images, specifications and prices current and accurate. However:

  • Images are representative of a product or product family. Colour, finish, packaging and minor design details may differ from the item delivered, and accessories shown are not included unless stated.
  • Dimensions, weights, sizes and other values are approximate and may vary within normal manufacturing tolerances or between production batches. Sizing differs between brands; please check the size guide for the product.
  • Please check the selling unit (for example each, pair, pack or carton) stated on the product page before ordering.
  • Manufacturer-supplied content. Much of the information, documentation and imagery on the Site is supplied by manufacturers and supply partners. We do not independently test or verify every specification of every product. Information may be updated by the manufacturer without notice.
  • Errors. Occasional errors can occur in descriptions, images, documents or prices. We may correct an error at any time. If an error materially affects an order you have placed, we will contact you with options, which may include proceeding on the corrected terms, choosing an alternative, or cancelling for a refund of undelivered goods.
  • If a particular specification, certification or feature is critical to your use, please contact us before purchase so we can confirm it against current manufacturer documentation.

5. Safety products: selection, standards and use

  • Selection is your responsibility. You are responsible for choosing products that are suitable for the hazards, tasks, people and conditions at your workplace, based on your own risk assessment and your work health and safety obligations. Protective equipment reduces risk; it does not eliminate it and does not replace other control measures.
  • General information only. Product descriptions, guides, finders, comparison tools and answers from our team or our website assistant are general information to help you choose. They are not a workplace risk assessment or professional safety, engineering, medical or legal advice. If you need advice specific to your site, consult a suitably qualified person.
  • Standards and compliance. Where a listing refers to a standard, rating or certification, the reference is based on the manufacturer's documentation. Supporting evidence can be requested from us. If a stated compliance cannot be substantiated for the item you ordered, you may cancel before dispatch for a refund or otherwise receive an appropriate remedy.
  • Use. Products must be used, fitted, inspected, maintained, stored and retired in accordance with the manufacturer's instructions, within rated limits, and by people who are competent and trained. Some products, such as respiratory protection, require correct fitting to work as intended.
  • Inspection and service life. Inspect products before each use and remove from service anything that is damaged, worn, expired or has been involved in an incident. Many safety products have a limited service life or an expiry date.
  • To the extent permitted by law, we are not liable for injury, loss or damage arising from incorrect selection, misuse, failure to follow instructions, lack of maintenance, unauthorised modification, inadequate training or supervision, or non-compliance with work health and safety obligations. Nothing in this clause excludes liability that cannot be excluded by law.

6. Website tools and our chat assistant

The chat on the Site is an automated assistant. It provides general information about products, orders and our store and passes requests to our team. Its answers may occasionally be incomplete or incorrect. Prices, availability and lead times are confirmed on the product page, at checkout and in our order communications. If an answer from the assistant differs from the product page, the checkout, these Terms or a written confirmation from our team, the latter prevail. A request sent through the chat or a form is a request for our team to review, not an acceptance or approval. Nothing in this clause limits your rights under the Australian Consumer Law.

7. Orders and acceptance

  • An order placed with us is an offer to purchase. An order confirmation acknowledges that we have received your order. We accept an order when the goods are dispatched or made ready for pickup, or when the service is confirmed.
  • Acting reasonably, we may decline or cancel an order in whole or in part, for example where an item is unavailable or discontinued, where there is an error in the price or description, where a delivery address cannot be serviced, for compliance reasons or where we suspect fraud or misuse. If we do, we will refund any amount paid for goods not supplied.
  • We may limit quantities and may decline orders that appear to be placed for resale without our agreement.

8. Availability and items supplied to order

  • Not every item listed on the Site is held at our warehouse. Many items remain available to order and are supplied through our supply partners. Availability information on the Site is a guide and can change quickly.
  • Lead times for items supplied to order vary. Please contact us for the lead time before ordering if timing matters to you.
  • If an item cannot be supplied within a reasonable time, or is discontinued by the manufacturer, we will contact you so that you can continue with a revised estimate, choose an alternative where available (with any price difference adjusted), or cancel that item for a refund.
  • In all cases your contract is with us. We remain your point of contact for the order, delivery, returns and warranty.

9. Prices, GST and payment

  • Prices are in Australian dollars and include GST unless stated otherwise. Shipping is shown at checkout or quoted separately.
  • Prices may change at any time before you place an order. Changes do not affect orders we have already accepted.
  • Accepted payment methods are shown at checkout. If a payment surcharge applies to a payment method, it is shown before you pay and does not exceed our cost of acceptance.
  • Card payments are processed by third-party payment service providers. Your statement may show our trading name, our company name or the provider's descriptor.
  • You will receive a tax invoice showing our ABN. A quote is valid for the period stated on it and is subject to availability and to these Terms.

10. Promotions and discount codes

Promotions, discount codes and special prices are time-limited, subject to availability and to any conditions stated with the offer, and may be withdrawn or changed before you place an order. Unless stated otherwise, they cannot be combined, transferred, redeemed for cash or applied to earlier orders. Promotional terms do not limit your non-excludable rights.

11. Delivery, pickup, returns and cancellations

Delivery and pickup are governed by our Shipping, Delivery and Pickup Policy. Returns, refunds and cancellations are governed by our Returns and Refunds Policy. All delivery timeframes are estimates. Change-of-mind returns are accepted only at our discretion and on the conditions set out in that Policy.

12. Custom and made-to-order goods

  • Custom signs, branded, printed or embroidered goods and other made-to-order items are produced to your instructions. You are responsible for the accuracy of the wording, sizes, quantities, colours and artwork you supply or approve, and for the suitability of a custom sign for the regulatory purpose you intend.
  • You confirm that you have the right to use any logo, artwork or text you ask us to reproduce.
  • Colours and placement may vary slightly from on-screen proofs. Production starts after you approve the proof and pay any required amount.
  • Once production has started, custom and made-to-order goods cannot be cancelled or returned for change of mind. Your rights where goods are faulty or not as approved are not affected.

13. Services

We offer services such as testing and tagging and workplace training. Services are supplied on the details confirmed at booking, and additional service terms may apply and will be given to you before you commit. Some services are delivered with or by qualified third-party providers. You are responsible for providing accurate information, safe access and a suitable environment for a service at your site. Requests to change or cancel a booking should be made as early as possible; costs we have reasonably incurred may be payable.

14. Warranties and consumer guarantees

Manufacturer warranties vary by product and are in addition to your rights under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Warranty claims require proof of purchase and a clear description of the fault. Normal wear and tear, misuse, incorrect fitting or installation, lack of maintenance and unauthorised modification are not covered, to the extent permitted by law. Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired, and refurbished parts may be used to repair the goods.

15. Title, risk and security interest

  • Title to goods passes to you only when we receive full cleared payment for them.
  • Risk passes as set out in our Shipping, Delivery and Pickup Policy.
  • Trade accounts only. If goods are supplied to a business before full payment, you grant us a security interest in those goods and their proceeds until they are paid for, and you agree that we may register that interest on the Personal Property Securities Register. Until payment, you must keep the goods identifiable and must not grant an inconsistent security over them. If payment is not made, we may recover unpaid goods lawfully and on reasonable notice. No registration is made for prepaid consumer purchases.

16. Acceptable use and fraud screening

You must not use the Site unlawfully or in a way that interferes with its operation. In particular you must not:

  • attempt to alter prices, availability, checkout logic or account privileges, or to bypass security, rate limits, verification or fraud controls;
  • use automated tools, bots or scraping to extract content or pricing or in a way that burdens the Site, or attempt to manipulate, overload or extract instructions from our chat assistant;
  • upload unlawful, harmful or malicious content or files; or
  • use stolen or unauthorised payment details or identities, or give false information.

We may refuse or cancel any order we reasonably suspect involves fraud, tampering or misuse, restrict access to the Site, and cooperate with payment providers and law enforcement. Amounts received for undelivered goods cancelled on this basis are refunded to the original payment method unless the law requires otherwise.

17. Site availability and security

We apply reasonable safeguards to the Site but do not guarantee that it will be uninterrupted, error-free or free of vulnerabilities. We may suspend access for maintenance or security. To the extent permitted by law, we are not liable for loss caused by events outside our reasonable control, including service interruptions and unauthorised access by third parties.

18. Intellectual property

All content on the Site, including text, logos, images, designs, documents and product data, is owned by us or our licensors and supply partners. It must not be copied, reproduced, adapted or used commercially without prior written consent. Brand names and trade marks of manufacturers remain the property of their owners.

19. Reviews and content you submit

If you submit a review, question, photo or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and publish it in connection with our business. We may remove content that is misleading, offensive, unlawful or in breach of these Terms.

20. External links

The Site may link to third-party websites and documents, such as manufacturer resources. They are provided for convenience only. We do not control and are not responsible for third-party content, availability, security or privacy practices, and a link is not an endorsement.

21. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, revenue, opportunity or business interruption. Where our liability cannot be excluded but can be limited, and the goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited to repairing or replacing the goods, supplying equivalent goods or paying the cost of doing so, and for services, supplying the services again or paying the cost of having them supplied again. Nothing in these Terms excludes or limits a right or remedy under the Australian Consumer Law, and no limitation applies to the extent that it would be unfair, prohibited or void under Australian law.

22. Indemnity

To the extent permitted by law, you indemnify us and our personnel against loss, cost, claim or expense arising from your breach of these Terms, misuse of the products, failure to follow manufacturer instructions, unsafe or non-compliant site conditions, or content or artwork you supply. This indemnity does not apply to the extent a loss is caused by our negligence or wrongful act, to the extent it would be unfair or void under Australian law, or to the extent it is inconsistent with a consumer's non-excludable rights.

23. Events outside our control

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including supply or carrier disruptions, industrial action, epidemics, natural disasters, acts of government and failures of utilities or telecommunications. We will take reasonable steps to limit the effect and resume performance as soon as practicable.

24. Privacy and marketing

Your use of the Site is subject to our Privacy and Cookie Policy. If you choose to receive marketing, you can unsubscribe at any time using the method included in each message.

25. Contracting entity and no personal liability

All goods and services are supplied solely by Aydin Consulting Specialist Pty Ltd (ABN 21 638 963 112), trading as Star Safety Supplies, which is the seller of record and the contracting party regardless of the brand, website or sales channel used. Payments received under our trading name are payments to that company. Our personnel, including employees, agents and contractors, act in a representative capacity only and do not assume personal liability. Any claim must be brought against the company only, except where the law does not permit this.

26. Changes to these Terms

We may update these Terms from time to time. Updates are posted on this page with a new effective date and apply from that date. Orders accepted before the effective date are not affected.

27. Governing law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and of the Commonwealth of Australia.

28. General

  • If any part of these Terms is invalid or unenforceable, it is severed and the rest continues to apply.
  • A failure to enforce a term is not a waiver of it.
  • We may assign our rights or subcontract performance on reasonable terms without reducing your protections. You may not assign your rights without our written consent, which will not be unreasonably withheld.
  • You agree to receive order confirmations, invoices and notices electronically at the contact details you provide.
  • If these Terms conflict with marketing material or a product brochure, these Terms prevail. A separate written agreement signed by us prevails for its subject matter.
